Valuation Interlink shall not be held responsible for unauthorized access to or alteration or interception of personal information or data, transmissions of other data, any material or data sent or received or not sent or received, or any transactions entered through Valuation Interlink.

Neither Valuation Interlink or any other party involved in providing this web site to the Internet community shall be liable for any direct, incidental, consequential, indirect or punitive damages or damages of any kind arising out of anyone's access, use or inability to use Valuation Interlink, or any errors or omissions in the content found therein. Customer Account and Restrictions
Valuation Interlink reserves the right to terminate access to any or all services at any time, without notice, for any reason.

Valuation Interlink reserves the right at all times to disclose any information as necessary to satisfy any applicable laws, regulation, or government request, or to edit, refuse to post or to remove any information, in whole or part, in sole discretion.

Your account username and/or password may not be assigned or transferred to any other person or entity.

You must promptly inform Valuation Interlink of any apparent breach of security, such as loss, theft, or unauthorized disclosure or use of a username or password.

Until Valuation Interlink is notified by e-mail or by telephone of any breach in security, you will remain fully liable for any unauthorized use of the web site.

The Workspace
This area of the Site is for the benefit of Users. The private and shared Workspace areas of the Site facilitate communication and the sharing of information between clients and appraisers once an appraisal has been accepted. The information contained in private Workspaces shared between client and appraiser is not used for any purposes other than to facilitate communication and the exchange of information between the parties involved. Valuation Interlink reserves the right to monitor communications in the Workspace in order to verify compliance with our Terms of Service, international, federal or state laws and/or our other stated policies.

Deliverability Disclaimers
Valuation Interlink does not guarantee any type of response or successful leads on any Valuation Interlink email that are sent through Valuation Interlink system. The response you receive will depend solely on the order in which you responded to through the email notification from Valuation Interlink.

Valuation Interlink cannot be held responsible or accountable for any inconsistencies in email flyer send deliverability due to personal email filters, business, office or network filters, domain blocks and filters, or any other programs, software or configurations that may unexpectedly or knowingly limit email deliverability on the recipient end..

Information and Press Releases
The Site contains information and press releases about us. We disclaim any duty or obligation to update this information or any press releases. Information about companies other than ours contained in the press release or otherwise, should not be relied upon as being provided or endorsed by us.

Valuation Interlink Provides the Venue
Valuation Interlink makes the Site available as an online venue where Clients and Appraisers locate and connect with each other and take advantage of the Services. Valuation Interlink is not involved in the dealing and contracting between Clients and Appraisers, or in the Appraisers' delivery of appraisal Services to Clients. Valuation Interlink has no control over and does not guarantee the quality, safety or legality of appraisal Services advertised, the truth or accuracy of listings, the qualifications, background, or abilities of Members, the ability of Appraisers to deliver Appraisal Services, the ability of Clients to pay for appraisal Services, or that a Client or Appraiser can or will actually complete a transaction.

Performance of Member Contracts
Upon acceptance of an appraisal assignment, the Client agrees to purchase, and the Appraiser agrees to deliver, the Appraisal Services in accordance with the assignment, the Terms of Service, and any other contract uploaded to the Site by the parties (collectively, the "Member Contract"). You agree not to enter into any contractual provisions in conflict with the Terms of Service. Any provision of a Member Contract in conflict with the Terms of Service is void. The Client and Appraiser each covenants and agrees to act with good faith and fair dealing in performance of the Member Contract. Furthermore, the Client and Appraiser each acknowledges and agrees that the value, reputation, and goodwill of the Site depend on their performance of the foregoing covenants and agreements. The Client and the Appraiser therefore agree that Valuation Interlink has the right to take such actions with respect to the Member Contract, including without limitation suspension, termination, or legal actions, as Valuation Interlink in its sole discretion deems necessary to protect the value, reputation, and goodwill of the Site.

Projects
By registering and signing up with Valuation Interlink, you acknowledge and agree that whenever you use our Connection Services you locate, choose, connect with and engage directly other Members of the Site to receive or deliver Appraisals in accordance with the Terms of Service. Valuation Interlink is not involved in the dealing or contracting between Clients and Appraisers for Appraisal Assignments, or in the Appraisers' delivery of said assignment to Clients.

Valuation Interlink is not a party to any contract for any appraisal assignment or any other Appraisal Services on the Site. All rights and obligations for the completion of any appraisal are solely between Clients and Appraisers. Each Client and Appraiser must look solely to the other for enforcement and performance of all the rights and obligations arising from Projects in accordance with the Terms of Service and any other terms, conditions, representations, or warranties associated with such dealings.

Payment Policy
All sales are final. Upon cancellation request your software application license will be cancelled before the next billing cycle.

Payment for goods, services and/or materials provided to you at or through this web site may be made by credit card or direct deposit, and you hereby authorize Valuation Interlink and its agents to transact such payments on your behalf.

You agree not to report as lost or stolen any credit card which you have used in conjunction with payment to Valuation Interlink for any goods or services for which you do not have good reason to believe is, in fact, lost or stolen.

You agree not to report a charge made by Valuation Interlink to your credit card as unauthorized for any goods or services for which you do not have good reason to believe is, in fact, unauthorized.

You agree that you will not seek and that Valuation Interlink need not provide any refund of payments made pursuant to this agreement except as specified.

You agree that Valuation Interlink is not responsible for any payment between appraisers, agents, and clients using our website. All transactions and payment arrangements are to be made between appraisers, agents, and clients, and Valuation Interlink does not involve itself in this process whatsoever, and is not to be held responsible for any lost payments between any parties involved.

You hereby agree that any such fraudulent reporting of a lost or stolen credit card used to obtain goods or services from this web site results in your liability to Valuation Interlink for liquidated damages of Twenty Thousand Dollars ($20,000.00). The liability for liquidated damages specified in this Paragraph shall not limit any other liability you may have for breach of any other terms, conditions, promises and warranties set forth in this Agreement.

You hereby agree that any such fraudulent reporting of an unauthorized charge to Valuation Interlink on your credit card which has been made by you or anyone under your authority, at a time when a charge or other obligation for payment for goods and/or services to Valuation Interlink remains outstanding at the time of such fraudulent reporting, results in your liability to Valuation Interlink for liquidated damages of Twenty Thousand Dollars ($20,000.00). The liability for liquidated damages specified in this Paragraph shall not limit any other liability you may have for breach of any other terms, conditions, promises and warranties set forth in this Agreement.

No Legal Advice or Attorney-Client Relationship
Information contained on or made available through the Site is not intended to and does not constitute legal advice, recommendations, mediation or counseling under any circumstance and no attorney-client relationship is formed. We do not warrant or guarantee the accurateness, completeness, adequacy or currency of the information contained in or linked to the Site. Your use of information on the Site or materials linked to the Site is entirely at your own risk. We are not a law firm and the Site is not a lawyer referral service.

Linking to the Site
You may provide links to the Site, provided (a) that you do not remove or obscure, by framing or otherwise, advertisements, the copyright notice, or other notices on the Site, (b) your site does not engage in illegal or pornographic activities, and (c) you discontinue providing links to the Site immediately upon request by us.

Valuation Interlink cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud, theft, harassment and other rights. We can (and you authorize us to) disclose any information about you if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; (b) protect or defend the rights or property of Valuation Interlink or third parties; or (c) assist in an investigation.

Modification of These Terms and Conditions
These terms of use may be modified at any time, without notice. It is the customer’s responsibility to check the terms of use section on a regular basis so they are aware of any changes. If, for any reason, any part of this agreement is deemed legally improper, inapplicable or inoperative, the remainder shall remain legally proper, applicable and operable.

Waiver; Severability
The failure of Valuation Interlink to exercise or enforce any right or provision of this agreement shall not constitute a waiver of such right or provision.

If any provision of this agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this agreement remain in full force and effect.

Release
If you have a dispute with another Member, you release Valuation Interlink (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute. You hereby waive California Civil Code §1542 (and any analogous law in any other applicable jurisdiction), which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

Entire Agreement
Use of the information, services and products offered in the Valuation Interlink web site is expressly conditioned upon acceptance of this agreement. This agreement represents the entire agreement between you and Valuation Interlink and supersedes any and all other communications, prior, contemporaneous or subsequent, and any course of performance or course of dealing, except as modified by revision of this page or in writing signed by an authorized agent of Valuation Interlink.

Agreement Interpretation and Enforcement
The laws of the State of California shall govern interpretation and enforcement of this agreement. You consent to personal jurisdiction in the federal and state courts of San Bernardino County, California, for any action arising out of or relating to your use of this web site and agree that the federal and state courts of San Bernardino County, California, shall have exclusive jurisdiction over such actions. In any such action, the prevailing party shall be entitled to recover all legal expenses incurred in connection with the action, including, but not limited to, its costs, both taxable and non-taxable, and reasonable attorneys' fees.
